References to "you" - The purpose of the present notice is to define the Insured Member (the user) Terms & Conditions under which we make the MyCover Application available to the user and the conditions under which the user may have access to and use the Application.
By accessing MyCover Application and using its content, you acknowledge and agree that you have read and understood the following terms and conditions of use, which we reserve the right to modify or update at any time, and agree to be bound by them. Warranty All content of the Application, including, but not limited to, functionalities, graphics, text and hyperlinks or references to other sites, is subject to alteration without prior notice and is provided "as is" and without warranty of any kind, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement and freedom from computer viruses or other harmful components.
While we have made all reasonable efforts to ensure that the information on the Application is accurate at the time of inclusion we do not make any warranties as to the adequacy, accuracy, reliability, completeness, performance or functionality of the Application or any information on the Application and expressly disclaim any liability for errors or omissions therein.
Copyright The application and its content are protected by copyright with all rights reserved. All rights to the screens and content are owned by us. Only personal, non- commercial use of the content is permitted. You are prohibited from copying, modifying, displaying, distributing, transmitting, redelivering through the use of "framing" technology, publishing, selling, licensing, creating derivative works or using any content, trademark or logo for any purpose without prior written approval from us.
We use tracking software to monitor client usage patterns to help us develop the design and layout of the Application. Security You can be assured that we have taken the necessary steps to protect your information by implementing the latest state-of-the-art technologies available. We have applied current industry standard security measures (i.e. SSL encryption).
Providing you with a secure online experience is a high priority for us. We recognize that your privacy and security are of the utmost importance, and we have devoted a great deal of time and effort to ensuring that your personal information is safeguarded. Please be aware that you are personally responsible for securing your account information. Please be careful and responsible whenever you are online.
Never share your login credentials with anyone and always logout from the Application after you are done from using it. While we aim to protect your personal information, we cannot ensure or warrant that it will be secure at all times from unauthorized use.
All of the information you transmit to us is done so at your own risk. What is data encryption? To help protect your personal information, we follow best practices of encryption of data in transit.
Encryption involves employment of sophisticated algorithms to scramble personal information that is being transferred from and back to us. Any data transmitted between the Application on your phone or computer to our servers is conducted using SSL and TLS Encryption, which ensures that your data is encrypted and Digitally Signed making it impossible to be read by hackers.
Liability To the extent permitted by law we exclude liability for any direct, indirect, incidental, special or consequential loss or damage that results from the use of or the inability to use the Application or third-party tools, your reliance on the content, or any failure of performance, interruption, defect, delay in transmission, computer viruses or other harmful components, or line or system failure associated with the Application or third-party tools, any changes to the Application or third-party tools, or any material or data sent or received or not sent or received, regardless of our knowledge thereof.
For your convenience certain hyperlinks or referenced websites in the Application may take you to third party websites. These websites are not maintained by us and if you enter other websites you will be subject to their terms and conditions. We will not be liable for the adequacy, accuracy, reliability or completeness of any information on hyperlinked or referenced websites and expressly disclaim any liability for any and all of their content.
Jurisdiction and Law Any disputes relating to the Application or to these terms shall be brought before the competent courts in Tunis, Tunisia, and will be governed and analyzed according to Tunisian law, on their merits, independently of the rules concerning conflicting legislation. Use of the digital solution indicates your express agreement to submit to the exclusive jurisdiction of those courts and further agreement that they are a convenient forum for you.
In the event that any provision of these terms is held unenforceable, the remaining provisions will not be affected, and the unenforceable provision will be replaced with provision that comes as close as possible to that of the unenforceable provision which it replaces effect of which comes.
OTHER IMPORTANT TERMS We may transfer our rights and obligations under these Terms to any any of our group companies, but this will not affect your rights or your obligations under these Terms. You may not transfer your rights or obligations under these Terms. If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. Each of the conditions of these Terms operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect.
These Terms constitute the entire agreement between us with respect to your use of the App. Such Terms supersede all prior understandings or agreements between us. In addition, in entering into these Terms you have not relied on and (in the absence of fraud) you shall have no right or remedy in respect of any statement, representation, assurance or warranty other than as set out in these Terms. No agency, partnership, joint venture or employment relationship is created as a result of these Terms and neither of us has any authority of any kind to bind the other in any respect.
